Part 1 Description: This session explores Regulation CC, where we will provide a comprehensive overview of its key provisions and requirements. This session will begin with a review of Subpart A, covering essential definitions, indorsement requirements, and forward collection obligations. We will then explore Subpart B, which outlines funds availability schedules, circumstances in which financial institutions may delay funds availability, and the necessary disclosure requirements to ensure compliance. Finally, we will examine Subpart D, focusing on substitute check warranties, the Check 21 Act, and related disclosure obligations.

Part 2 Description: This session explores Regulation CC, focusing on Subpart C’s collection and return requirements. This session will cover key aspects such as expeditious return obligations, the responsibilities of the bank of first deposit when handling returned checks, and important warranties and indemnities, including Remote Deposit Capture (RDC) Indemnity and Electronically Created Item (ECI) Indemnity. We will also examine the Presumption of Alteration rule and its impact on dispute resolution, along with a review of Regulation CC’s statute of limitations.
