Description: This session explores Article 4 of the Uniform Commercial Code (UCC) and its impact on check law. This session will cover essential definitions and provide a clear understanding of when an item is considered properly payable under UCC Article 4. We will explore key considerations for post-dated and stale-dated checks, as well as a customer’s right to stop payment and the responsibilities associated with reporting unauthorized signatures or alterations. Additionally, we will review transfer and presentment warranties, outlining the obligations and protections for financial institutions and customers. The discussion will conclude with an overview of the statute of limitations for various check-related claims.
