Payment exceptions, especially those related to resolving errors and reports of unauthorized activity, continues to be one of the most common themes of questions we receive at UMACHA. During this workshop, we will provide an overview of Reg E and consumer liability. We will focus on how a financial institution’s obligations under Reg E must be handled in conjunction with obligations under the Nacha Operating Rules, including requirements if a consumer reports unauthorized ACH debits that are beyond the 60-calendar day return timeframe – and how a financial institution can attempt to recover the funds and avoid taking a loss. Processing ACH returns is a critical component of an RDFI's responsibilities, and errors can be costly and result in an RDFI's inability to return transactions. Regardless of whether you are an ODFI, RDFI, or both, you are making warranties and indemnities to other ACH Network participants every day. This session discusses what a warranty and indemnity are and why you should understand the warranties and indemnities you are making. The session takes a deep dive into the warranties and indemnities regarding ACH authorizations, Notifications of Change, and transactions where an Eligible Source Document (i.e. check) is converted to an ACH debit. Finally, the session wraps up with a discussion on what to do when you are unable to resolve a dispute with another financial institution regarding an asserted breach of warranty.
